Introduction

1.1     The Crohn’s & Colitis UK Spring Raffle (“the Raffle”) is licensed and regulated in Great Britain by the Gambling Commission under account number 32704 in the name of The National Association for Colitis and Crohn’s Disease. 

1.2     The Raffle is promoted by the Promoter and conducted for the benefit of people who are affected by Crohn’s Disease and Ulcerative Colitis and all other forms of Inflammatory Bowel Disease. 

1.3     The person responsible for the promotion of the Raffle is Claire Walsh, on behalf of Crohn's & Colitis UK. 

1.4      By entering the Raffle, Members agree to be bound by these rules. 

 Definitions 

“Act” - The Gambling Act 2005

“Raffle” - The Crohn’s & Colitis UK Spring Raffle 

“Draw” - The process by which winners are selected 

“Rules” - The rules of the Raffle as set out below and amended from time to time 

“Chance” - The entry into the Raffle


Entry into the Raffle

The Raffle is promoted in accordance with the Gambling Act 2005 as amended (“the Act”) throughout Great Britain.  In order to comply with the Act, during the purchase of Raffle Chances you will be required to confirm that 

2.1     You are at least 18 years of age 

2.2     You will not buy or claim to buy raffle chances on behalf of any other person 

2.3     If, upon winning any prize in the Raffle, you are not able to prove that you have met the criteria specified in Rules 2.1 and 2.2 above then you will not be entitled to receive that prize. 

2.4    The Raffle Promoter, the Promoter’s employees and employees of any company involved in running the Raffle are prohibited from entering the Raffle. 

2.5     In order to comply with the Act raffle chances that have been purchased and entered into the draw for which they were intended are prohibited from being subsequently refunded. 

2.6     By entering into the Raffle you agree to be bound by the Rules, and applicable provisions of the Act and any relevant regulations made there under from time to time. Crohn’s & Colitis UK shall not be liable for any loss or damage (including loss of the opportunity to enter the Raffle and / or the right to receive a prize) suffered by you if you have not complied with the Rules.  The Rules may be amended by Crohn’s & Colitis UK from time to time. 

2.7     This Raffle is a form of gambling. Participants are encouraged to gamble sensibly. Should gambling become a problem we recommend you contact the Gamble Aware helpline on 0808 8020 133 or visit the website on begambleaware.org 

2.8     The maximum number of entries an individual will be permitted to purchase in any one draw is 100. 

2.9     The Promoter will send 20 tickets to individuals in an initial mailing. Requests for additional tickets can be made by emailing raffle@crohnsandcolitis.org.uk or by calling 0370 058 5956.Or you can purchase online at www.crohnsandcolitis.org.uk/springraffle 


Purchasing a chance in the Raffle

3.1     You can only enter the Raffle by the purchase of a ticket which will be published in a variety of forms from time to time. 

3.2     You will be required to provide the following information: 

(a)     Your name and address, so that we can write to you to confirm if you have won a prize. 

(b)     Confirmation that you are over 18 years of age, in order to ensure compliance with the Act. 

(c)     The number of Chances in the Raffle you wish to purchase 

3.3     You will also be asked to provide your telephone number and email address as alternative ways of contacting you in the event of queries or if you have won a prize. 

3.4     You will also be required to provide information relating to the purchase of your Chances.  Payment may be made via the following methods and the relevant information will vary depending upon the payment method. 

(a)     Cheque 

(i)     A completed cheque would be required when you purchase a chance 

(b)     Debit Card 

(i)     Information required will include card number, expiry date and card security number. 

(c)     Any other method made available by Crohn’s & Colitis UK from time to time 

(i)     The information required will depend upon the payment method 

3.5     Crohn’s & Colitis UK shall be entitled to take any steps necessary to verify the above information and to process your purchase. Crohn’s & Colitis UK may (in its absolute discretion) refuse to accept an application for an individual to support the Raffle. 

3.6     It is your responsibility to ensure that the personal information you provide to us is accurate. 

3.7     Each Raffle Ticket Number is unique. 

3.8     Tickets can only be sold to or by people aged 18 years or over. 

3.9     Tickets must not be sold on the street 


Payment

4.1     Payment for Chances may be made by the following methods: 

(a)     Cheque 

(b)     Debit Card 

(c)     Any other method made available by Crohn’s & Colitis UK from time to time 

4.2     Payment for Chances are made directly to Crohn’s & Colitis UK. Therefore 

(a)     Cheques must be made payable to Crohn’s & Colitis UK 

(b)     Any other method made available by Crohn’s & Colitis UK from time to time would also be referenced as or be payable to Crohn’s & Colitis UK on any appropriate documentation. 

4.3     The price for each Chance is £1. 

4.4     Your Chances and therefore associated Raffle Ticket Number(s) will not be entered into the Draw unless Crohn’s & Colitis UK has received all amounts payable (cleared funds) relating to your Chances by the published cut-off date of the draw.  If there is a dispute regarding whether Chances have been paid for then such dispute shall be decided by the Raffle promoter. 

4.5     All customer funds paid to the Raffle are held in trustee status until the conclusion of the 2024 Raffle to maintain a separation from Crohn’s & Colitis UK own trading income to protect those funds in the event of insolvency. 

4.6     Crohn’s & Colitis UK may cancel your entry into the Raffle (in its absolute discretion) at any time prior to the published cut-off date. Crohn’s & Colitis UK will notify you accordingly as soon as reasonably practicable and will reimburse any amounts which have been paid. Other than the reimbursement of any such amounts, Crohn’s & Colitis UK shall not be liable for any loss or damage (including loss of the opportunity to enter the Raffle and / or the right to receive a prize) suffered by you in relation to such cancellation. 

4.7     All customer funds paid to the Raffle are held in trustee status to maintain a separation from Crohn’s & Colitis UK own trading income to protect those funds in the event of insolvency. 


Draws

5.1     The Draw will be run at our Raffle Management Companies Offices to be held on Friday 28th June 2024

5.2     In order to comply with the Act only those Chances for which payment has been received by Friday 21st June 2024 are eligible for entry into the Draw. 


Prizes

6.1     Prizes are issued as follows: 

(a)     First Prize £2,500.00

(b)     Second Prize £500.00

(c)     Third Prize £250.00 

6.2     Crohn’s & Colitis UK reserves the right to amend the prizes at any time.  Any such changes will be published on the Crohn’s & Colitis UK website at least one month prior to a change being made. 

6.3     Each Ticket Number shall only be entitled to win one prize in one Draw. 

6.4     The results of the Draw will be published on the Crohn’s & Colitis UK website within one week of the date of the draw and may also be published in any other manner determined by Crohn’s & Colitis UK from time to time. 

6.5     Winners will be notified by post, email or telephone within one week of the date of the draw.  Winners will be offered payment of their prize by bank transfer or. 

6.6     Crohn’s & Colitis UK reserves the right to withhold the payment of any prize until it is entirely satisfied that the purchaser who has won the prize has fully complied with the Rules. 

6.7     If, upon winning any prize in the Raffle, you are not able to prove that you have met the criteria specified in Rules 2.1 (a) and (b) above then you will not be entitled to receive that prize. 

6.8     There are no alternatives to the prizes offered from time to time and no interest is payable. 

6.9     Any unclaimed prizes will be re-credited to the Crohn’s & Colitis UK’s main account after a period of six months has elapsed. 

6.10    By accepting the prize, the winner agrees to take part in promotional activity and Crohn’s & Colitis UK reserves the right to use the name and address of the winner, their photograph and audio/or visual recordings of them in any publicity unless prior notification has been received. 


Suspension of the Raffle

Crohn’s & Colitis UK may (at its absolute discretion) suspend the Raffle for any period of time. During such period Crohn’s & Colitis UK shall retain any amounts which were paid retain any amounts which were paid prior to such suspension taking effect. You will be notified of further details regarding the resumption of the raffle or otherwise as soon as reasonably practicable after the date of suspension in writing. 


Liability

8.1     Crohn’s & Colitis UK shall not be liable to you for any loss or damage suffered by you arising from: 

(a)     Any delays or failures in the postal service or other delivery methods used by Crohn’s & Colitis UK or you from time to time. 

(b)     Any delays or failures in any systems used by Crohn’s & Colitis UK or you to transmit e-mails. 

(c)     Any failure in any software or other systems used by Crohn’s & Colitis UK for the administration of the Lottery. 

(d)     Any delays of failures in the banking system used by Crohn’s & Colitis UK or you. 

(e)     Any failure to enter your Chance into the Draw. 

(f)     Any event beyond the reasonable control of Crohn’s & Colitis UK 

8.2     Crohn’s & Colitis UK shall not be liable to you in contract, tort, and negligence or otherwise for any indirect or consequential loss suffered by you in relation to your participation in the Raffle (including loss of the opportunity to enter the Raffle and / or the chance of winning a prize). 


Complaints

9.1     Crohn’s & Colitis UK is committed to providing good quality services and the highest possible customer care at all times. We recognise, however, that we may sometimes get things wrong or make mistakes. We do not look on complaints as unwanted. In fact, they may help us to see where our services or practices might be improved. So do let us know where you feel we have made a mistake or done something that you found unsatisfactory or unacceptable. Even if you do not think your particular concern amounts to a ‘complaint’ we would still like to know about it. You may help us to deal with something we would otherwise overlook. 

9.2     Making a complaint 

(a)     In the first instance please contact a member of the Fundraising team who will either provide an immediate response (where possible) or carry out further investigations. Upon providing a response you will be asked whether you are satisfied with the same. If you are unhappy with the response provided the matter will be escalated to the Director of Income Generation. 

(b)     An acknowledgement of your escalation of the complaint to the Director of Income Generation will be sent within five working days of receipt and an investigation will begin. The Director will make every reasonable effort to write to you with the outcome of the investigation and any proposed action within a further five working days. 

(c)     If the matter is still unresolved you should make a formal complaint to The Chief Executive. On receipt of a formal complaint you will receive a reply within 5 working days and a copy of the Crohn’s & Colitis UK Complaints Procedure. 

(d)     If the matter remains unresolved your complaint will be forwarded to the Board of Trustees for consideration. 

(e)     If this fails to bring about a resolution, the complaint will be referred to the Independent Betting Adjudication Service (IBAS) for arbitration. 

Any complaints relating to the Raffle should be sent in writing to Crohn’s & Colitis UK giving full details of the complaint and supporting documentation. 


Privacy

10.1       Crohn’s & Colitis UK is committed to protecting your privacy.  Data that we collect from you is used lawfully in accordance with the General Data Protection Regulation 2018 and, unless you have given your clear consent, is used solely for the purpose of processing your purchase of Raffle chances, subsequent entry into the Raffle, and informing you if you have won a prize. 

10.2     You have the right to access the information we hold about you.  To obtain this information, please contact Crohn’s & Colitis UK in writing.  You may be asked to provide proof of your identity prior to personal information being disclosed to you. 

10.3     Crohn’s & Colitis UK will not sell, rent or grant access to any of the personal data we collect about you to any third parties without your express prior permission. 

10.4     We may share aggregated information to third parties.  This will not contain personal information that can identify any individual person. 

10.5     We may be obliged to disclose your personal information if required to do so by law, for example to statutory bodies such as the Gambling Commission or other government bodies. 


Proper Law and Jurisdiction

11.1     The Laws of England and Wales shall govern the interpretation and/or enforcement of these Rules and Crohn’s & Colitis UK and all entrants hereby submit to the exclusive jurisdiction of the English courts.
